Terms and Conditions

These terms describe the rules for using Pondera Health and the responsibilities that come with using the app. Review the conditions for your account and profiles, the Premium subscription, the health and artificial intelligence notices and the limits of the service before using the app.

1. Acceptance of these terms

By creating an account or using Pondera Health ("Pondera", "the app"), you agree to these Terms and Conditions and to the Privacy Policy. If you do not agree with any of them, do not use the app.

2. Who can use Pondera

To create an account you must be at least 18 years old, or the age of majority where you live if that is higher.

An account can hold profiles for other people, such as family members, including minors. A minor's profile may only be created and managed by their parent or legal guardian, who must be the account holder. By creating it, the account holder authorizes the collection and processing of that profile's data and is responsible for how it is used. Minors must not create or use an account of their own.

3. What the app offers

Pondera helps you log your meals in a nutrition diary, look up foods (including by barcode, using data from Open Food Facts), calculate calorie and macronutrient goals, and track your weight, body composition and progress photos.

Some features are available only with the Premium subscription. The features included in each plan may change over time.

4. Account and profiles

You are responsible for the information in your account, for keeping your credentials confidential and for all activity that happens with them. If you suspect unauthorized access, change your password and contact us.

If you manage several profiles, you must have the permission of each adult whose data you log and make sure the information in each profile is accurate.

5. Linked and shared profiles

Pondera lets you link profiles between accounts and share information with other people. When you share a profile, the other account can see it and, depending on how you share it, log information in it.

You decide who you share with, and you can stop sharing at any time from the app. Share only with people you trust and only information you have the right to share. Anyone given access to someone else's profile must use it only for the purpose it was shared for.

6. Information you log

The information you enter in Pondera, such as foods, goals, measurements, photos or personal details, remains yours, and you are responsible for its accuracy.

You allow us to process that information as needed to provide the service: showing summaries, metrics and history and running the app's features, as described in the Privacy Policy.

7. Health notice

Pondera is a wellness logging and tracking tool. It does not provide medical or nutritional advice, it is not a medical device, and it does not diagnose, treat, cure or prevent any disease.

Calorie and macronutrient goals and other calculations are based on published formulas, such as Mifflin-St Jeor, whose sources are cited in the app. They are approximate estimates for the general population and may not fit your situation.

Talk to a doctor or a registered dietitian before changing your diet or your weight. Pondera is not suitable as guidance during pregnancy or breastfeeding, or for people with eating disorders or chronic conditions such as diabetes or kidney or heart disease. If you have a medical emergency, call emergency services.

8. Artificial intelligence features

Pondera offers AI features, when available, such as meal-photo analysis. These features use third-party artificial intelligence providers to process the content you submit.

Results are automated estimates that may be inaccurate or incomplete: review and correct any data before saving it. AI responses are not medical or nutritional advice. AI features may have usage limits and may change or stop being available.

9. Premium subscription and automatic renewal

Premium is an auto-renewing subscription, monthly or yearly, purchased in the app through the Apple App Store or Google Play. The price and billing period are shown before you confirm the purchase.

Payment is charged to your store account when you confirm the purchase. The subscription renews automatically at the same price and for the same period, and the store charges each renewal, unless you cancel at least 24 hours before the end of the current period.

If the price changes, Apple or Google will notify you under their rules and, where required, ask you to accept the new price before it applies. A new price only takes effect from the next renewal, and you can cancel beforehand if you do not agree.

10. Cancellation and refunds

You can cancel at any time from your store account settings:

• iPhone or iPad: Settings -> your name -> Subscriptions -> Pondera Health -> Cancel Subscription.

• Android: Google Play -> your profile icon -> Payments & subscriptions -> Subscriptions -> Pondera Health -> Cancel subscription.

Uninstalling the app or deleting your account does not cancel the subscription. When you cancel, you keep Premium until the end of the period already paid for, and your account then continues on the free plan.

Charges and refunds are handled by Apple or Google under their policies: for Apple, at reportaproblem.apple.com; for Google Play, under its refund policy. See the Cancellation Policy for details.

11. Coupons and promotions

On Android, Pondera may accept coupons that grant free Premium access for a period of time or that unlock a discount applied by the store. On iPhone and iPad, discounts are offered only through App Store offer codes.

Coupons are personal, have no cash value, cannot be exchanged for money or transferred, may have a limited number of redemptions and an expiration date, and may be revoked if they were obtained or used improperly. Each promotion may have additional conditions, which are stated when it is offered.

12. Apple App Store downloads

If you download Pondera from the App Store, your use of the app is governed by Apple's standard Licensed Application End User License Agreement, which these terms supplement. These terms are an agreement between you and Pondera, not Apple.

Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the app, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Acceptable use

When using Pondera, you agree not to:

• Access or attempt to access other people's accounts, profiles or data without permission.

• Interfere with, overload, reverse engineer or bypass the security measures or usage limits of the service, or scrape data by automated means.

• Upload content that is illegal, offensive or infringes the rights of others, including photos of other people without their consent.

• Use the app for unlawful purposes or resell the service.

14. Service availability

We work to keep the app available and running properly, but we do not guarantee uninterrupted or error-free operation.

We may make changes, perform maintenance, release improvements or suspend the service temporarily, and we may modify or remove features. When a change significantly affects a paid feature, we will give reasonable advance notice.

15. Intellectual property

The design, brand, interfaces, text, graphics and other elements of Pondera belong to their owners and may not be copied, distributed or reused without permission.

We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the app under these terms. No other rights are granted.

16. Suspension and termination

You can stop using Pondera at any time and delete your account from the app, as explained in Account deletion. Deletion is permanent and does not cancel your store subscription.

We may suspend or close your account if you breach these terms, if the law requires it, or if your use puts other people or the service at risk. Where possible, we will notify you and explain why.

17. Disclaimer of warranties

To the fullest extent permitted by law, Pondera is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that nutrition information, calculations or AI results are accurate or complete.

18. Limitation of liability

To the fullest extent permitted by law, Pondera will not be liable for any indirect, incidental, special, consequential or punitive damages, for any loss of data, revenue or profits, or for damages arising from decisions made based on information in the app.

To the same extent, our total liability for any claim relating to the app is limited to the amount you paid for Pondera in the 12 months before the claim. Some jurisdictions do not allow these exclusions or limitations; where that is the case, they apply only to the extent the law allows.

19. Changes to these terms

We may update these terms. The current version is the one published on this page, with its last-updated date.

If we make material changes, we will notify you in advance in the app or by email. If you keep using Pondera after they take effect, you accept them; if you do not agree, you can stop using the app and delete your account.
